Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the onomo platform and all associated services. This AUP is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in immediate suspension or termination of your account without notice or refund.

You agree not to engage in any of the following activities:

2.1 Illegal Activity

• Using the Service for any purpose that violates any applicable local, state, national, or international law or regulation
• Uploading, distributing, or transmitting content that infringes upon the intellectual property rights of any third party
• Using the Service to facilitate fraud, money laundering, or any other financial crime
• Distributing malware, viruses, worms, or any other malicious code through the Service

2.2 Abuse of the Service

• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of any part of the Service, including synthesizer engines, effects processors, DSP algorithms, or AudioWorklet code
• Circumventing, disabling, or interfering with any security, authentication, rate-limiting, or access-control features
• Using automated tools, bots, scrapers, or scripts to access, interact with, or extract data from the Service
• Attempting to probe, scan, or test the vulnerability of the Service or any related system or network
• Interfering with or disrupting the Service, servers, or networks connected to the Service
• Accessing or attempting to access another user's account, data, or projects without authorization
• Using the Service to operate, develop, or benchmark a competing product or service

2.3 Account Abuse

• Creating multiple accounts to circumvent free-tier usage limits, AI credit limits, or storage limits
• Creating multiple accounts to abuse referral programs, promotional offers, or tutorial reward credits
• Sharing account credentials with other individuals
• Selling, transferring, or renting access to your account
• Using disposable email addresses or temporary accounts to exploit free-tier benefits
• Impersonating any person, entity, or onomo staff member
• Filing fraudulent chargebacks or payment disputes after legitimate use of the Service
• Giving a false birth month or year, or creating another account, to get around an age restriction or teen account protections

2.4 Content Restrictions

These restrictions apply to content you upload, create, generate (including with AI), store, or distribute through the Service. You agree not to upload, generate, or distribute content that:

• Is defamatory, libelous, threatening, harassing, or abusive
• Promotes violence, terrorism, hate speech, self-harm, or discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or national origin
• Sexually exploits or endangers minors, including any child sexual abuse material (“CSAM”), whether real, AI-generated, or otherwise. We report CSAM to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law.
• Depicts a real, identifiable person in a sexual or intimate manner without their consent (non-consensual intimate imagery), whether real or synthetic
• Contains nudity or sexual content of any kind, whether real, drawn, or AI-generated. This applies to everyone, including adults and content labeled Explicit
• You do not have the right to share, including copyrighted material you do not own or have a license to use
• Is intended to defraud, deceive, or impersonate, including marketplace content that is misleadingly described, non-functional, or intentionally low-quality

2.5 Explicit Labeling

Content with strong language or mature themes (for example, profanity, drug or alcohol references, or graphic but non-sexual violence in lyrics or art) must be labeled Explicit when you post, publish, or share it. Explicit content is hidden from teen accounts, from accounts that have not given a birth date, and from signed-out visitors. You agree not to:

• Post, publish, or share content that needs the Explicit label without it
• Remove or work around an Explicit label added by onomo, or one carried over from an original song, linked song, or remix
• Use the Explicit label as permission for content this AUP prohibits. The label covers language and themes only; nudity and sexual content are never allowed

onomo may add the Explicit label to any content or profile, lock it, or remove the content. Repeatedly leaving content unlabeled may lead to the enforcement actions in Section 6.

2.6 Protecting Minors

People aged 13 to 17 use onomo with teen account protections (see our Terms of Service). You agree not to:

• Contact, message, or collaborate with anyone under 18 for a sexual purpose, including sexual comments, requests for images, or attempts to build trust in order to exploit them (grooming)
• Pressure a teen to move a conversation to another app or platform, to share personal contact details, or to meet in person
• Evade or attempt to evade teen account protections, for example by creating accounts, using another person's account, asking a teen to follow you only so you can message them, or using groups, shared links, or collaboration invites to reach a teen who has not chosen to hear from you
• Encourage anyone to misstate their age

Violations of this section are serious violations. We may terminate the account without warning and report the conduct to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.

onomo's AI features — the Ono assistant and AI image and video generation — are provided as creative tools. You agree not to:

• Use any AI feature to generate content that promotes violence, hate speech, harassment, self-harm, or illegal activity, or that is otherwise prohibited under Section 2.4
• Generate nudity or sexual imagery of anyone, including intimate imagery of a real, identifiable person or any sexual content involving minors — see Section 2.4
• Create deepfakes or clone a person's voice, face, or likeness in order to deceive, defraud, harass, or impersonate, or in violation of any person's rights of publicity or privacy
• Generate content designed to spread disinformation or to impersonate a real person, brand, or organization in a misleading way
• Attempt to extract, replicate, or reverse-engineer any AI model, its weights, training data, or system prompts
• Use automated tools to send bulk AI requests or to systematically drain AI credits or grants through scripted interactions
• Attempt to “jailbreak” or bypass any AI safety filter or content policy
• Misrepresent AI-generated content as entirely human-created where such a representation would be deceptive (e.g., a human-only competition)

You are responsible for the content you generate and for ensuring its use is lawful and does not infringe the rights of others.

To ensure a fair and reliable experience for all users, the Service implements rate limits and usage caps on various features including AI messages, storage, API requests, and export processing. These limits are determined by your subscription tier.

Attempting to circumvent rate limits through any means — including but not limited to creating multiple accounts, using automated tools, exploiting API endpoints, or manipulating request headers — is a violation of this AUP.

We reserve the right to throttle or temporarily restrict access to any user whose usage patterns indicate abuse or place an unreasonable burden on our infrastructure, even if the user has not technically exceeded their plan's stated limits.

If you sell content on the onomo marketplace, you additionally agree to:

• Only sell content that you have created or have full rights and licenses to distribute
• Accurately describe your content, including its contents, compatibility, and any limitations
• Not sell content that is substantially similar to free content already available in the Service
• Not engage in price manipulation, fake reviews, or other deceptive marketplace practices
• Respond to buyer inquiries and support requests in a timely manner
• Comply with all applicable tax laws and reporting requirements for your marketplace earnings

We reserve the right to investigate and take appropriate action against any user who violates this AUP, including but not limited to:

• Warning: Issuing a written warning for minor or first-time violations
• Content Removal: Removing or disabling access to content that violates this AUP
• Feature Restriction: Temporarily restricting access to specific features (e.g., AI, marketplace, export)
• Account Suspension: Temporarily suspending your account pending investigation
• Account Termination: Permanently terminating your account without refund
• Legal Action: Pursuing legal remedies, including reporting to law enforcement where appropriate

The severity of enforcement action will be determined at our sole discretion based on the nature, severity, and frequency of the violation. We are not obligated to provide advance warning before taking enforcement action for serious violations.

The fastest way to report a post, song, comment, profile, or message is the Report option on it in the app. Reporting a post, comment, or message also hides it from you right away. If content should carry the Explicit label but doesn't, choose Should be marked Explicit as the reason.

You can also report any violation of this AUP to us at abuse@onomo.io. Include as much detail as possible, including the username or content in question and a description of the violation. We will investigate all reports and take appropriate action.

If you believe a child is in danger, contact local law enforcement first. You can also report child sexual exploitation to NCMEC's CyberTipline at report.cybertip.org.

For copyright infringement reports, please follow the DMCA process described in our Copyright Policy.

We may update this AUP at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised AUP.
