Acceptable Use Policy

1. Overview

This Acceptable Use Policy (“AUP”) governs your use of the onomo platform and all associated services. This AUP is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in immediate suspension or termination of your account without notice or refund.

2. Prohibited Conduct

You agree not to engage in any of the following activities:

2.1 Illegal Activity

  • Using the Service for any purpose that violates any applicable local, state, national, or international law or regulation
  • Uploading, distributing, or transmitting content that infringes upon the intellectual property rights of any third party
  • Using the Service to facilitate fraud, money laundering, or any other financial crime
  • Distributing malware, viruses, worms, or any other malicious code through the Service

2.2 Abuse of the Service

  • Reverse engineering, decompiling, disassembling, or attempting to derive the source code of any part of the Service, including synthesizer engines, effects processors, DSP algorithms, or AudioWorklet code
  • Circumventing, disabling, or interfering with any security, authentication, rate-limiting, or access-control features
  • Using automated tools, bots, scrapers, or scripts to access, interact with, or extract data from the Service
  • Attempting to probe, scan, or test the vulnerability of the Service or any related system or network
  • Interfering with or disrupting the Service, servers, or networks connected to the Service
  • Accessing or attempting to access another user's account, data, or projects without authorization
  • Using the Service to operate, develop, or benchmark a competing product or service

2.3 Account Abuse

  • Creating multiple accounts to circumvent free-tier usage limits, AI credit limits, or storage limits
  • Creating multiple accounts to abuse referral programs, promotional offers, or tutorial reward credits
  • Sharing account credentials with other individuals
  • Selling, transferring, or renting access to your account
  • Using disposable email addresses or temporary accounts to exploit free-tier benefits
  • Impersonating any person, entity, or onomo staff member
  • Filing fraudulent chargebacks or payment disputes after legitimate use of the Service

2.4 Content Restrictions

  • Uploading or distributing content that is defamatory, libelous, threatening, harassing, or abusive
  • Uploading or distributing content that promotes violence, terrorism, hate speech, or discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or national origin
  • Uploading or distributing sexually explicit content involving minors
  • Uploading or distributing content that you do not have the right to share
  • Selling marketplace content that contains copyrighted material you do not own or have license to distribute
  • Selling marketplace content that is misleadingly described, non-functional, or intentionally low-quality

3. AI-Specific Restrictions

The AIRESS AI co-producer is provided as a creative tool for music production. You agree not to:

  • Use the AI system to generate content that promotes violence, hate speech, harassment, self-harm, or illegal activity
  • Attempt to extract, replicate, or reverse-engineer the AI system's training data, model weights, or system prompts
  • Use automated tools to send bulk AI requests or to systematically exhaust AI credits through scripted interactions
  • Attempt to “jailbreak” or bypass the AI system's safety filters or content policies
  • Use the AI system for purposes unrelated to music production (e.g., generating code, writing essays, or other non-musical tasks)
  • Resell or commercially redistribute raw AI-generated output without meaningful creative modification
  • Represent AI-generated content as entirely human-created in contexts where such representation would be deceptive (e.g., AI music competitions with human-only rules)

4. Rate Limits and Fair Use

To ensure a fair and reliable experience for all users, the Service implements rate limits and usage caps on various features including AI messages, storage, API requests, and export processing. These limits are determined by your subscription tier.

Attempting to circumvent rate limits through any means — including but not limited to creating multiple accounts, using automated tools, exploiting API endpoints, or manipulating request headers — is a violation of this AUP.

We reserve the right to throttle or temporarily restrict access to any user whose usage patterns indicate abuse or place an unreasonable burden on our infrastructure, even if the user has not technically exceeded their plan's stated limits.

5. Marketplace Creator Obligations

If you sell content on the onomo marketplace, you additionally agree to:

  • Only sell content that you have created or have full rights and licenses to distribute
  • Accurately describe your content, including its contents, compatibility, and any limitations
  • Not sell content that is substantially similar to free content already available in the Service
  • Not engage in price manipulation, fake reviews, or other deceptive marketplace practices
  • Respond to buyer inquiries and support requests in a timely manner
  • Comply with all applicable tax laws and reporting requirements for your marketplace earnings

6. Enforcement

We reserve the right to investigate and take appropriate action against any user who violates this AUP, including but not limited to:

  • Warning: Issuing a written warning for minor or first-time violations
  • Content Removal: Removing or disabling access to content that violates this AUP
  • Feature Restriction: Temporarily restricting access to specific features (e.g., AI, marketplace, export)
  • Account Suspension: Temporarily suspending your account pending investigation
  • Account Termination: Permanently terminating your account without refund
  • Legal Action: Pursuing legal remedies, including reporting to law enforcement where appropriate

The severity of enforcement action will be determined at our sole discretion based on the nature, severity, and frequency of the violation. We are not obligated to provide advance warning before taking enforcement action for serious violations.

7. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at abuse@onomo.io. Include as much detail as possible, including the username or content in question and a description of the violation. We will investigate all reports and take appropriate action.

8. Changes to This Policy

We may update this AUP at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised AUP.
